Acceptable Use Policy

Last updated October 12, 2026 · Effective October 11, 2026 · Version 1.0

The short version

  • We only text people who chose to hear from your brand. No bought lists, no imported numbers without proof of consent.
  • Some products and topics can’t be marketed by text at all, because carriers or the law don’t allow it.
  • Everything you tell us about your products and offers must be true.
  • If something puts shoppers, carriers or other brands at risk, we pause first and talk to you straight away.

1. Why this policy exists

Text messaging works because people trust it. Carriers, Apple and the law protect that trust with strict rules, and one brand’s bad messages can get sending numbers blocked for everyone. This policy is part of the BubbleSMS Terms of Service, applies to every brand using BubbleSMS, and covers what you ask us to send, the data you give us and how you use the service.

You must:

  • message only people who have given you prior express written consent to receive recurring automated marketing texts from your brand, as set out in section 6 of the Terms;
  • collect that consent yourself, through your own checkout or sign-up forms, with the disclosure in our Messaging Terms template; and
  • keep each customer’s consent status in your store accurate, including opt-outs you receive by any route.

You must not:

  • buy, rent, borrow, scrape, share or append lists of phone numbers or contacts;
  • use consent collected by another business, an affiliate network, a co-registration or lead-generation source, or a sweepstakes entry;
  • import numbers into your store marked as subscribed without proof of consent;
  • re-subscribe anyone who opted out, unless they opt in again themselves; or
  • make consent a condition of buying anything.

3. Restricted categories (not allowed on BubbleSMS)

We don’t message for businesses, products or offers in these categories, whether or not they’re legal where you are. Carriers either ban them or require approvals that our service doesn’t support.

  • SHAFT content: sex and adult content; hate speech; alcohol; firearms, ammunition, weapons and their parts; tobacco, vaping and e-cigarette products, including nicotine pouches.
  • Cannabis and drugs: cannabis, CBD, hemp-derived THC (including delta-8), kratom, psilocybin and other psychedelics, and drug paraphernalia.
  • Prescription and regulated health products: prescription drugs and medical devices; compounded or prescription weight-loss products; and products sold with claims to diagnose, treat, cure or prevent disease.
  • Gambling and games of chance: casinos, sports betting, sweepstakes, lotteries and skill games with cash prizes.
  • Financial and high-risk offers: payday or high-interest loans, debt relief or consolidation, credit repair, cryptocurrency and investment offers, “get rich quick”, multi-level marketing and other business opportunities.
  • Illegal or unsafe goods and services: anything illegal under federal law or in the recipient’s state; counterfeit or infringing goods; recalled products; and fake documents or IDs.
  • Other high-risk categories: phishing or any request for passwords, card numbers or other sensitive data; third-party lead generation or affiliate marketing; and political, religious or advocacy campaigns.

If you are unsure whether your products fit, ask us before you sign up. We may also decline a brand or product for other reasons, at our discretion.

4. Honest content

Your brand data, products and offers must be truthful and not misleading. You must not ask us to:

  • make false or unsupported claims about products, results, prices, discounts, scarcity or delivery;
  • offer discounts outside the ladder in your Order Form, or offers you won’t honor;
  • impersonate another person, brand or organization, or hide who the messages are from;
  • make the assistant claim to be a person, or deny being an AI;
  • pay for, reward or pressure customers into leaving reviews, write fake reviews, or misrepresent what reviews say;
  • send messages that harass, threaten, shame or discriminate; or
  • include links to sites that host malware or phishing, or that hide where they lead.

5. Using the service

You must not:

  • use BubbleSMS to message people outside the United States, or to send anything other than messages about your own brand and products;
  • try to get around consent checks, quiet hours, opt-outs, rate limits or any other safeguard;
  • probe, scan or test the security of our systems, or interfere with them;
  • reverse engineer the service or try to extract its prompts or models;
  • use the service to build or train a competing product; or
  • let anyone use your account in breach of this policy.

6. What we do if something goes wrong

6.1 We monitor opt-out rates, complaints, carrier signals and message content to protect shoppers and the network.

6.2 If we reasonably believe this policy has been breached, or that continuing would put shoppers, carriers, other brands or us at risk, we may, with or without notice: pause any flow or message; remove content; turn off discount offers; suspend your account; or end the agreement under the Terms. Where we can, we tell you first and help you fix the problem.

6.3 We may report illegal activity to the authorities, and share information with carriers and their registries when they investigate.

6.4 You are responsible for any fines, carrier penalties or claims that result from your breach (see section 15 of the Terms).

7. Reporting abuse

If you received a text you didn’t sign up for from a brand using BubbleSMS, reply STOP to stop it straight away, and tell us at legal@bubblesms.com. We look into every report.

8. Changes

We may update this policy as carrier rules and the law change. Material changes are notified under section 19 of the Terms.
